security correspondent jennifer griffin reports from the pentagon. >> at 4:50 a.m. on november 1, just days before the u.s. presidential election, two iranian frog foot fighter jets like these intercepted and fired twice upon an unmanned, unarmed u.s. predator drone over the persian gulf. it is the first time the iranians have ever fired on a u.s. drone. the shots missed on both attempts and iran's fighter pilots briefly pursued the drone which land safely at an undisclosed location. >> the incident occurred over international waters, approximately 16 nautical miles off the iranian coast line. our aircraft was never in iranian air space. it was always flying in international air space. the internationally recognized territorial limit is 12 nautical miles off the coast. and we never entered the 12 nautical mile limit. >> asked whether the i want was an act of war, the pentagon spokesman said he would not legally label it, adding the state department had protested through the swiss protective powers, which have represented the u.s. government in tehran since the u.s. embassy takeover in 1979.
. joining me now from the pentagon fox news national security correspondent jennifer griffin with the latest. jennifer, i know you have been working your sources on this at the pentagon and if he cia. what do we know now and when was this issue of the affair first exposed? how did it come about? >> well, the first that it was exposed in terms of the conversation with the president occurred yesterday. general petraeus went over to the white house and he told the president that he thought he should resign. but what we're now learning from sources close to the fbi is that the fbi had been investigating general petraeus and as part of a larger investigation, the name of paula broadwell, who is general petraeus' biographer. she wrote a book that came out in january called-"all in, the education of general david h. petraeus." she had spent about a year in afghanistan with him, documenting his life, and it seems that the fbi was investigating something broader. her name came up. they started investigating concern that general petraeus now head of the cia was possibly some sort of victim in it or co
attacked a u.s. military drone. the pentagon says the attack occurred last thursday in international air space over the persian gulf. >> unarmed, unmanned, u.s. mq1 aircraft conducting routine surveillance over the iranian gulf was intercepted by iranian su-25 aircraft and was fired upon with guns. >> little says the iranian jets fired at least twice at the drone but failed to hit it. the u.s. believes the pilots intended to shoot the aircraft down. he says the u.s. uses drones for reconnaissance in accordance with international rules and that the country will continue to conduct such flights. the obama administration has intensified its surveillance of iran. it has also stepped up economic sanctions. the actions are part of efforts to pressure iran to suspend its nuclear development program. analysts say the attack on the drone reflects iran's growing frustration over the u.s. actions. >>> the man who shot u.s. congresswoman gabrielle giffords in the head and killed six people has been sentenced to life in prison. the shooting rampage took place in january last year in the state of ariz
